These Terms and Conditions (”Terms”) govern your use of the Lomalo digital wallet application (”Lomalo” or “the App”). Please read them carefully. By downloading, installing, or using Lomalo, you agree to be bound by these Terms. “Lomalo” is a brand and marketing name operated by MIBONDGlobal LLC (d/b/a M1 Global). All references to “Lomalo” in this document refer to the digital wallet service developed, owned, and managed by MIBOND GlobalLLC. The company is the sole legal entity responsible for the app, its data, and its operations.
By using Lomalo, you agree to the practices described in this Privacy Policy.
1. Definitions
- “App” or “Lomalo” means the Lomalo digital wallet.
- “We,” “Us,” and “Our” means M1 Global LLC (d/b/a MIBOND), the operator of Lomalo.
- “You” or “Your” means the individual user who downloads, registers, or uses Lomalo.
- “Government” refers to the Government of the Republic of the Marshall Islands (RMI), for which this App was developed.
2. Relationship to Other Agreements
These Terms govern your use of Lomalo only. They do not replace or alter:
- Any agreement you have with your bank or payment provider; or
- Any agreement you may have with the Government of the Marshall Islands related to benefit programs or other services.
3. Eligibility
Lomalo is available to individuals worldwide. When registering, you must accurately specify your country of origin.
You may not use Lomalo for unlawful activity, including money laundering, terrorism financing, fraud, or any prohibited conduct under applicable law.
4. Security Obligations
You agree to:
- Keep your device, passwords, PINs, and biometrics secure.
- Notify us immediately if your device or account is lost, stolen, or compromised.
- Not use Lomalo on any device you know (or should know) has been compromised, rooted, or jailbroken.
5. Suspension and Termination
We may suspend, restrict, or terminate your access to Lomalo at our discretion, including for reasons of:
- Fraud or suspected fraud
- Misuse of the App
- Compliance or technical risks
- Failure to comply with these Terms
You may stop using Lomalo at any time by deleting the App.
6. Fees
Lomalo is currently provided free of charge. We reserve the right to introduce service fees in the future, with advance notice provided to you in accordance with applicable law.
7. Privacy and Data Use
By using Lomalo, you agree that we may collect and process the following:
- Usage data tied to your account and transaction history
- Device and technical data needed to operate the App
We may share this information with:
- Government authorities in the Republic of the Marshall Islands
- International agencies, as required by Marshall Islands law, including for anti-money laundering (AML), countering the financing of terrorism (CFT), and customer due diligence (CDD) purposes
We take reasonable measures to protect your information. However, you acknowledge that transmission over digital networks may carry risk, and we cannot guarantee complete security.
8. Disclaimers and Limitation of Liability
Lomalo is provided”as is” and “as available.”
- We make no warranty that the App will be error-free, uninterrupted, or always accepted by merchants.
- We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data.
-Our total liability to you for any claim relating to Lomalo will not exceed the amount of fees (if any) you paid us in the 12 months prior to the claim.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of the Marshall Islands.Any dispute shall be resolved exclusively in the courts of the Republic of the Marshall Islands.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice within the App or by other means permitted by law. Continued use of Lomalo after changes take effect constitutes acceptance of the revised Terms.
